This can often result in lengthy investigations, involving other local authority Health Departments where the food is found to have been manufactured in another district. The purpose of such investigations is to prevent recurrences of the same complaint in the future, and to establish if the individual or company responsible is able to establish a due diligence defence, i.e. that they have taken all precautions that could reasonably have been expected of them. If this proves not to be the case, then the Council has the option to prosecute.
