Your Privacy is very important to Breckland District Council. This page explains how information about you will be held and processed by Breckland District Council.

Who we are

Breckland District Council will be the Data Controller for the personal information it collects via its Public Space, Car parks and Council Offices CCTV system. Personal information can be anything that identifies and relates to a living person.

What information is collected

"Personal data" is any information about a living individual, which allows them to be identified from that data (for example a name, photographs, videos, email address, or address).

The processing of personal data is governed by legislation relating to personal data, which applies to the United Kingdom including General Data Protection Regulation (the "GDPR") and other legislation relating to personal data and rights such as the Human Rights Act.

Breckland District Council currently has CCTV installed in its offices in Dereham and Thetford, the attached car parks and central Market Town locations within the District (see Appendix 1), including council owned car parks. We may install CCTV (Closed Circuit Television) cameras in various locations within the district as and when required.

These recordings contain images of the public going about their daily business as well as potential offenders, persons wanted and missing

Generally, signs are displayed in all locations, notifying you that overt CCTV is in operation and providing details of whom to contact for further information about the scheme.

There may be occasions, where targeted footage of private property or where the council needs to use covert CCTV and therefore there will be no signs displayed notifying you that CCTV is in operation. On such occasions the council will comply with all relevant legislation, including the Regulation of Investigatory Powers Act (RIPA).

Why we collect your personal data

Breckland will use CCTV for the purposes of public safety, traffic management and the prevention and detection of crime and disorder.

The main purpose of the CCTV system is to provide assistance to the police and enforcement agencies to:

  • Detect, deter and prevent crime and disorder.
  • Help identify, apprehend and prosecute offenders.
  • Provide the police/council with evidence to enable criminal and/or civil proceedings to be brought in the courts.
  • Maintain public order.

Some examples of how we use your data are provided below; please note this is not an exhaustive list:

  • providing evidence in criminal proceedings (Police and Criminal Evidence Act 1984 and Criminal Procedure and Investigation Act 1996)
  • providing evidence in civil proceedings
  • the prevention and reduction of crime and disorder
  • the investigation and detection of crime
  • identification of witnesses

The legal basis for holding and processing the data comes under;

  • Section 163 of the Criminal Justice and Public Order Act 1994
  • Crime and Disorder Act 1998
  • Protection of Freedoms Act 2012
  • In certain Circumstances - Regulation of Investigatory Powers Act
  • Public task - Article 6.1(e) the "GDPR" -  processing is necessary for us to perform a task in the public interest or for our official functions, and the task or function has a clear basis in law

How information will be used

The council has a duty to protect the public funds it administers and may use information held about you for all lawful purposes, including, but not limited to;

  • prevention and detection of fraud
  • for the interests of public safety
  • the apprehension or prosecution of offenders
  • to continue to deliver services
  • protecting public funds in investigating misuse of public money

Who we may share your information with

We will only disclose CCTV recordings or images to third parties such as the police to comply with a legal obligation, or where legally permitted, such as for crime prevention and detection

The CCTV database is used to record incidents that are actioned by the CCTV control room staff situated at Kings Lynn. This information can be used as an evidential log if needed for enforcement and/or court. It is also used to produce reports, charts etc for performance and intelligence purposes as well as for internal/external partner agencies and Norfolk Police.

Where CCTV has recorded evidence to support an investigation into a criminal offence or a civil action the footage may be shared on social media 

We may pass your information to other agencies or organisations such as Land Registry, HM Revenues and Customs, and debt enforcement agencies, as allowed by law.

We also share with Insurance Companies when authorised by the Legal Team. It also acts as a reference for operators to use on shift handover. We will record the details of each incident, what happened, any outcomes and what action was taken.

We will not disclose your personal information to third parties for marketing or sales purposes or for any commercial use, and we will not use your personal data in a way which may cause you harm.

Accessing the information we hold about you

You have the right to request, in writing, details of the information that is held about you and also the right to access a copy of the footage. This may be by the Council providing copies of documents or by inviting you to view the footage at one of its offices, if appropriate.

How long we keep information about you

All CCTV recordings are retained by Kings Lynn & West Norfolk Borough Council working in partnership with Breckland District Council for a period of 30 days and will be deleted thereafter. However, on occasions there may be a need to keep images for longer - for example where a crime is being investigated.
