Abbey Thetford
Breckland Council received and made valid an outline planning application reference 3PL/2024/0394/O (opens new window), relating to the Abbey Estate in Thetford on 30th April 2024 for:
'Outline planning permission for demolition and phased development of residential units (up to 500 units uplift) including special care units and HMOs (Classes C3, C2 and C4) and up to 1,600 sq. metres of flexible floor space for purposes within Class E (commercial, business and service), Class F1 (Learning and non-residential institutions), Class F2 (Local Community) and sui generis uses (launderette and hot food takeaways); external alterations to existing properties; together with associated highway, engineering and landscape works. All detailed matters except access points at boundary approved for future determination'.
This application was refused at Planning Committee and a decision was issued on 29 October 2025 with the following reason for refusal:
The proposed development, as submitted - and notwithstanding its overall compliance with the Development Plan - is considered to breach Article 8 of the Human Rights Act 1998 and the Public Sector Equality Duty as set out in Section 149 of the 2010 Equality Act.
It is considered that:
- the proposed demolition of over half of the existing dwellings on the estate (551 out of 1,087) along with 726 garages, retail and community buildings (all of which are presently shown only on illustrative plans and therefore cannot be identified with any precision),
- the illustrative nature of the phasing of the development over a 20 year period
- the illustrative plans for the works of regeneration including the provision of new buildings and potential loss of open space have already caused unacceptable uncertainty for the residents and community of the Abbey Estate, which in turn, has had an unacceptable impact on their mental health and wellbeing. On balance, it is considered that the ongoing and unacceptable impacts to mental health and wellbeing of the residents (including in particular the elderly, the infirmed and children) and the community cohesion of the Abbey Estate caused by up to 20 years of further disruption and uncertainty, taken together significantly and demonstrably outweigh the benefits of the proposed development. Notwithstanding its overall compliance with the Development Plan, these material considerations indicate a decision other than in accordance with the Development Plan."
The Planning Inspectorate has now received an appeal against refusal of this planning application. The Council is in the process of going through the appeal documentation, which includes a request to for the appeal to be heard as a public inquiry. Once all the relevant information and requests from the Inspectorate have been met, the Council will receive a 'start date' letter, with all the details of the appeals process, which will be made available on the application file for members of the public to view. The Local Planning Authority will advise interested parties of the appeal start date, and the date by which any representations should be made
