The Dogs (Fouling of Land) Act 1996

The Breckland District Council Dogs (Fouling of Land) Designation Order 1999

The Breckland District Council (in this order called "the council") hereby make the following Order:

  1. The land described in the Schedule below being laid in the area of the council which is land to which the Dogs (Fouling of Land) Act 1996 applies, is hereby designated for the purposes of that Act
  2. This Order may be cited as The Breckland District Council Dogs (Fouling of Land) Designation Order 1999 and shall come into force on 1 April 1999
  3. Once this Order has taken effect, it shall be an offence for a person who is in charge of a dog which at any time fouls on designated land to fail to remove the faeces forthwith from the land

Schedule

This Order applies to all land within the administrative area of Breckland District Council which is open to the air (including covered land which is open to the air on at least one side) and to which the public are entitled to have access (with or without payment) subject to the exemptions contained in Section 1, sub-sections (2) (3) and (4) of the Act.

The Act does not apply to the following land or area:

(a) Land comprised in or running alongside a highway with a speed limit of more than 40mph.

(b) Land used for agriculture or for woodlands.

(c) Rural Common Land.

(d) Land which is predominantly marshland, moor or heath.

(e) Land where a private Act confers for the regulation of the land. The person entitled to exercise those powers may by notice in writing to the Local Authority (Breckland District Council) exclude the application of the Order, as defined in Section 1 of the Dogs (Fouling of Land) Act 1996.
